Measures to improve the system of external labor migration adopted

Uzbek President Shavkat Mirziyoyev signed a resolution “On additional measures to further improve the system of external labor migration of the Republic of Uzbekistan”.

The document noted that starting from 1 September 2018, legal entities, registered in Uzbekistan, have the right to carry out activities for sending the Uzbek citizens to work to foreign states on the basis of a license issued by the Ministry of Employment and Labor Relations of the Republic of Uzbekistan.

Legal entities also have the right to carry out activities to confirm the professional competence of citizens of the Republic of Uzbekistan, traveling abroad for work, including the level of possession of professional skills and foreign languages, on the basis of accreditation conducted by the Ministry of Employment and Labor Relations of the Republic of Uzbekistan.

The President defined the Agency for External Labor Migration under the Ministry of Employment and Labor Relations of the Republic of Uzbekistan as the working body, which performs the functions of reviewing applications for the issuance of licenses and accreditation, and preparing the necessary documents.

According to the document, under the Ministry of Employment and Labor Relations of the Republic of Uzbekistan, a Fund is created to support and protect the rights and interests of citizens who work abroad.

The Fund will provide legal and social protection, as well as material assistance to citizens who have been subjected to violence, forced labor and discrimination, violation of labor and other rights that have fallen into a difficult financial situation and left without documents, establishing an identity, means of subsistence during the period of employment for abroad.

The new structure will provide medical services to migrants from Uzbekistan if it is not possible to pay the cost of medical services provided at the expense of a labor migrant with subsequent reimbursement of paid funds by these citizens;

The fund will also deal with the transportation of bodies of citizens, who died during labor migration outside the country, as well as citizens who were injured or seriously injured while working abroad, resulting in disability.

The Fund will also return citizens sent abroad to work and deported due to violation of the legislation of the host country, with subsequent reimbursement of paid funds at the expense of these citizens, as well as the return of citizens to whom foreign employers have not provided agreed terms for employment.

The Fund will receive a one-time gratuitous financial aid in the amount of 200 billion soums (currency rates of CB RU from 01.07.2018, 1$= 7813.42 soums) from the state budget. The fund’s activities will also be financed from other sources.

From 1 August 2018, the procedure for issuing permission to work abroad has been abolished, with the introduction of a procedure for the voluntary registration of citizens traveling abroad to perform labor activities under private labor contracts in the manner established by the Ministry of Employment and Labor Relations of the Republic of Uzbekistan.

Also from 1 August, an order is introduced for voluntary payment of annual insurance contributions to the off-budget Pension Fund under the Ministry of Finance, in the amount of 4,5 times of the minimum wage.
